- INTRODUCTION
These Terms and Conditions (“Terms”) govern the relationship between Modern British Academy (“Academy,” “we,” “us,” or “our”) and any individual (“Student,” “you,” or “your”) who enrolls in our professional development courses, diploma programs, English language courses, or uses any of our services or facilities.
By enrolling in any course or program offered by Modern British Academy, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not proceed with enrollment.
- ENROLLMENT AND ADMISSION
2.1 Eligibility
– Enrollment is open to individuals who meet the specified prerequisites for each course or program.
– The Academy reserves the right to request verification of eligibility requirements.
– Minimum age requirements may apply to specific courses and programs.
2.2 Application Process
– All prospective students must complete the official application process.
– Submission of an application does not guarantee acceptance.
– The Academy reserves the right to accept or reject applications at its discretion.
– False information provided during the application process may result in immediate termination of enrollment without refund.
– Enrollment is confirmed only upon:
– Receipt of all required documentation
– Payment of applicable fees
– Written confirmation from the Academy
- FEES AND PAYMENT
– All fees are as specified in the current fee schedule available on our website or from our administrative office.
– Fees are subject to periodic review and may change.
– The Academy will provide notice of any fee changes at least 30 days before implementation.
3.2 Payment
– Full payment or agreed installment payments must be made by the specified deadlines.
– Late payments may incur additional charges as specified in the fee schedule.
– The Academy reserves the right to suspend access to courses if payment obligations are not met. 3.3 Refund Policy
– Refund requests must be submitted in writing to the administration office.
– Refunds are processed according to the following schedule:
– Withdrawal before course commencement: 80% refund
– Withdrawal within first week of course: 50% refund – Withdrawal after first week: No refund
– Registration and administration fees are non-refundable.
- COURSE DELIVERY AND PARTICIPATION
4.1 Course Schedule
– Course schedules are provided upon enrollment confirmation.
– The Academy reserves the right to make reasonable adjustments to schedules, giving students reasonable notice when possible.
4.2 Attendance
– Regular attendance is required for all courses.
– Students must maintain the minimum attendance rate specified for each course or program.
– Failure to meet attendance requirements may result in disqualification from examinations or certification.
4.3 Course Materials
– Course materials provided by the Academy are for personal use only.
– Reproduction, distribution, or commercial use of course materials is strictly prohibited unless expressly permitted in writing.
– Additional materials not provided by the Academy may be required for some courses at the student’s expense.
4.4 Mode of Delivery
– Courses may be delivered in-person, online, or through a hybrid model.
– The Academy reserves the right to change the delivery mode if circumstances require, providing reasonable notice when possible.
- ASSESSMENT AND CERTIFICATION
5.1 Assessment Methods
– Assessment methods will be specified in the course outline for each program.
– The Academy reserves the right to modify assessment methods if necessary, providing students with reasonable notice.
5.2 Grading
– Grading criteria will be provided at the beginning of each course.
– All decisions regarding grades are at the discretion of the course instructors and academic board.
– Appeals must follow the official appeals process outlined in the Student Handbook.
5.3 Certification
– Certificates or diplomas will be issued only upon:
– Successful completion of all required coursework
– Achievement of passing grades in all assessments
– Meeting minimum attendance requirements
– Full payment of all applicable fees
5.4 Academic Integrity
– Plagiarism, cheating, or any form of academic dishonesty will not be tolerated.
– Instances of academic dishonesty may result in:
– Failure of the assignment, test, or course
– Suspension or expulsion from the Academy
– Revocation of certificates already awarded
- STUDENT CONDUCT
– Students must conduct themselves professionally and respectfully.
– Harassment, discrimination, or bullying of any kind will not be tolerated.
– Students must comply with all Academy policies and procedures.
6.2 Disciplinary Actions
– The Academy reserves the right to take disciplinary action against students who violate these Terms or the Student Code of Conduct.
– Disciplinary actions may include warnings, suspension, or expulsion, depending on the severity of the violation.
– No refunds will be provided in cases of expulsion due to misconduct.
- HEALTH AND SAFETY
– Students must inform the Academy of any medical conditions that may affect their participation.
– Students must follow all health and safety guidelines provided by the Academy.
7.2 Academy Responsibility
– The Academy will maintain reasonable health and safety standards.
– In case of emergencies, the Academy will follow established protocols and may contact emergency services if necessary.

- DATA PROTECTION AND PRIVACY
8.1 Data Collection
– The Academy collects and processes personal data in accordance with applicable data protection laws.
– By enrolling, students consent to the collection and processing of their personal data for educational and administrative purposes.
8.2 Data Security
– The Academy implements reasonable security measures to protect student data.
– Student data will not be shared with third parties without consent, except as required by law.
8.3 Marketing Communications
– Students may opt in to receive marketing communications from the Academy.
– Students may withdraw consent for marketing communications at any time.- INTELLECTUAL PROPERTY
9.1 Academy Intellectual Property
– All intellectual property rights in course materials, including but not limited to copyrights, trademarks, and patents, remain the property of the Academy or its licensors.
9.2 Student Work
– Students retain intellectual property rights to original work created during their courses, subject to the Academy’s right to:
– Use student work for educational, promotional, or accreditation purposes
– Retain copies of student work for record-keeping purposes

- LIABILITY AND INSURANCE
– The Academy is not liable for any indirect, incidental, or consequential damages arising from enrollment or participation in courses.
– The Academy’s total liability shall not exceed the amount of fees paid by the student.
10.2 Insurance
– Students are responsible for obtaining appropriate insurance coverage for their personal belongings and health.
– The Academy maintains insurance as required by law but does not provide individual insurance for students.- CHANGES TO COURSES AND PROGRAMS
11.1 Course Modifications
– The Academy reserves the right to make reasonable changes to course content, faculty, or structure to maintain quality and relevance.
– Significant changes will be communicated to affected students with reasonable notice.
11.2 Program Discontinuation
– The Academy reserves the right to discontinue programs or courses.
– In case of program discontinuation, the Academy will make reasonable efforts to:
– Allow enrolled students to complete their studies
– Offer suitable alternatives
– Process refunds where completion or alternatives are not possible- FORCE MAJEURE
The Academy shall not be liable for failure to perform any obligation under these Terms if such failure is caused by circumstances beyond reasonable control, including but not limited to natural disasters, acts of government, epidemics, pandemics, civil unrest, or terrorist attacks.- COMPLAINTS AND DISPUTE RESOLUTION
13.1 Complaints Procedure
– Students should first attempt to resolve issues informally with relevant staff.
– Formal complaints must be submitted in written email or to the admission team.
– The Academy will acknowledge receipt of formal complaints within 5 working days and aim to resolve them within 28 days.- TERMINATION
– Students may terminate their enrollment by providing written notice.
– Refund eligibility will be determined according to the refund policy in Section 3.3. 14.2 Termination by Academy
– The Academy may terminate a student’s enrollment due to:
– Violation of these Terms or the Student Code of Conduct
– Failure to meet academic requirements
– Non-payment of fees
– Provision of false information ## 15. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction where Academy operates], without regard to its conflict of law provisions.
For Teacher-Training Courses Terms & Conditions: As a teacher applying for the course, I understand and agree to the following:- I am completely committed to the course and will be able to meet my deadlines.
- I am obliged to attend at least 90% of the course otherwise I will jeopardize my chances of passing.
- I will be expected to be there on time for all course-related sessions and that lateness will be recorded as an absence.
- I am aware that I will have to complete a great deal of work outside course hours.
- I understand that I am expected to behave professionally, particularly with regard to punctuality and cooperation with everyone on the course. I further understand that confrontational or aggressive behaviors toward tutors, admin staff or colleagues are unacceptable and could cause grounds for dismissal from the course.
- I am aware that payment of the course fees does not guarantee that I will pass the course. I understand that assistance will be provided in good time and accept that it is a personal choice to accept the advice given or not.
